Privacy Policy - Data Privacy Statement
This privacy notice discloses the privacy practices for Counselling Madrid Therapists - CMT (The Counselling Service). This privacy notice applies solely to information collected by this website. It will notify you of the following:
  •     What personally identifiable information is collected from you through the website, how it is used and with whom it may be shared.
  •     What choices are available to you regarding the use of your data.
  •     The security procedures in place to protect the misuse of your information.
  •     How you can correct any inaccuracies in the information.
The Counselling Service complies with the General Data Protection Regulation 2016/679. The GDPR is a regulation in EU law on data protection and privacy for all individuals within the European Union and the European Economic Area. The GDPR requires us to obtain a client’s consent for records to be kept and so we ask you to sign this consent form. Basic information is recorded when clients schedule their first session. This information (email correspondence) is deleted after your first appointment.

Information Collection, Use and Sharing
The Counselling Service is the sole owner of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.

We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our team. To fulfill your session appointment requests we will share the information collected, online and during intake sessions, with the therapist you will work with for ongoing sessions.

Both clients and therapists agree that explicit written consent needs to be obtained from both parties in order to record and/or share any session related material such as voice and video recordings, emails and phonecalls. This consent needs to be obtained by signing the "AUTHORIZATION TO RECORD/RELEASE/EXCHANGE CONFIDENTIAL INFORMATION" form, and can be obtained by sending an email to admin@counsellingmadrid.org

Confidentiality  and Record Keeping
 Confidentiality is an essential part of all counselling and psychotherapy. Each therapist holds records and personal contact details securely and will ensure confidentiality in the treatment of any information held about its clients, in line with the Code of Ethics of the BACP and equivalents.  All information recorded and held is solely for the purpose of  maintaining effective therapeutic treatment.
 
What data do we hold and why?
We hold the contact data from your initial online appointment request and assessment sheets, on paper, so that we can contact you and, if necessary, refer you. We record information about what you tell us in our sessions depending on the protocol we are using.  Often, we record only brief hand written notes and these act as an 'aide memoire' so that we can review the course of your therapy as time progresses. We record the number of sessions you have and the payments you make for business purposes. We will discuss with you how you like to be contacted, and it is important that while you remain a client you notify us if any of these details change.

How is information stored and when is information deleted?
Most session notes are held on paper and kept locked securely when not in use. Data held electronically is on a personal computer and stored locally in a password protected account.  Phone and email contact details may be held on a password protected work phone.

We record appointments on paper diaries/agendas and/or on digital devices. We also record data electronically about the number of sessions and the payments you make.  Case records are held in line with insurance company guidelines.

Who is information shared with?
All information will be kept confidential unless the client and therapist agree to discuss something with a third party such as your GP. Where appropriate a consent form will be used. The only reasons for breaking confidentiality would be if the therapist considered that your life, or the life of someone else, was at risk, or if the therapist was liable to civil or criminal court proceedings. If at all possible this will be discussed with the client beforehand. 

Your Access to and Control Over Information
You may opt out of any future contacts from us at any time. You can do the following at any time by contacting us via the email address or phone number given on our website:
  •   See what data we have about you, if any.
  •   Change/correct any data we have about you.
  •   Have us delete any data we have about you.
  •   Express any concern you have about our use of your data.

Security
We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Wherever we collect information, that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for "https" at the beginning of the address of this website: https://www.counsellingmadrid.org/

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

Revocation, Changes, Corrections and Updates
The users are entitled to obtain information on any stored personal data relating to them upon request and free of charge. Furthermore, they have the right to correct, disable, and delete their personal data, unless there is legal obligation for it to be archived. In the course of our Offers’ further development, we will also update our data privacy statement continuously. Any changes will be announced on this page on a timely basis. For this reason, our users should visit this page from time to time, in order to be up-to-date regarding our data privacy statement.

Practice Guidelines
 Anti-discrimination policy
The Counselling Service is strongly committed to anti-discrimination. It values difference and diversity and does not discriminate on the grounds of age, gender and gender identity, sexual preference or orientation, marital/partnership status, religion, race, colour, national origin, disability, heritage or political belief.

Medical care
It is strongly advised that if you are concerned about any aspect of your physical or psychological well being that you consult with your GP for an up to date evaluation of your health needs.

The Counselling Service is not a crisis resource
If you are in crisis and need immediate help, please contact your local emergency services, go to the nearest emergency room or call 112.

Code of Ethics and Referrals
CMT Therapists are fully qualified (*) and abide by the Code of Ethics of their member organisations. As independent practitioners we are regulated by the following member organisations: BACP (UK), UKCP (UK), SEA (UK), VEN (The Netherlands), COP (Spain) and have our individual terms and conditions. Some CMT Therapists are not based in the Madrid region and therefore only provide online sessions. If you want to work with a Madrid based Therapist please inform us when submitting the "Schedule your Session" online form.

(*) At times Students are working with clients at the Counselling Service. These Students are finishing their last year of training and are supervised.

Cancellation and missed session policy
If for any reason you are unable to attend your appointment, please let us know as soon as possible. The required notice for cancellation is strictly two days. Where there is less notice of cancellation, or if you do not attend without notice, you will be charged the full fee. With adequate advanced notice clients will be offered an alternative appointment for their next session.
 
Law and jurisdiction
These terms shall be governed by and construed in accordance with the laws of Spain and the parties hereby submit to the exclusive jurisdiction of the Spanish courts in Madrid.

Cookies
Cookies are small files that allow device-specific information to be stored on the user’s device (PC, smartphone, or the like). On the one hand, they serve users by increasing the usability of websites (e.g. by remembering log-in data), and on the other hand, they serve to gather statistical data about the website’s usage for analysis to improve the Offers.

The users may influence the use of the cookies. Most browsers feature an option which limits or completely prevents the storage of cookies. However, one should be aware of the fact that the use of websites and especially their usability is limited without cookies. We save cookies on our users’ hard drive if they do not block this actively.
